This Ordinance may be called the Andhra Pradesh Grama Sachivalayams and Ward Sachivalayams (GSWS) Ordinance,2022. It extends to the whole of the State of Andhra Pradesh

GSWS Ordinance - 15/2022 AP Ordinance of Grama Sachivalayams and Ward Sachivalayams

Promulgated by the Governor in the Seventy Third Year of the Republic of India.
AN ORDINANCE TO PROVIDE A NEW STRUCTURE TO DELIVER INNUMERABLE OTHER CITIZEN CENTRIC SERVICES AND AMENITIES INCLUDING THE INDICATIVE LIST OF CITIZEN SERVICES MENTIONED IN THE 11TH SCHEDULE AND 12 TH SCHEDULE OF THE CONSTITUTION OF INDIAAND TO PROVIDE A STATUTORY FRAMEWORK FOR THE GRAMA SACHIVALAYAMS AND WARD SACHIVALAYAMS AND FOR MATTERS CONNECTED THEREWITH OR INCIDENTAL THERETO.

Whereas, Grama Sachivalayams and Ward Sachivalayams have been conceptualized in order to ensure the last mile deliveiy of welfare schemes and other citizen centric services offered by the Union and the State Government in the State of Andhra Pradesh. The aim is to ensure that the welfare schemes reach the intended beneficiaries in a flawless manner and the administration of the State reaches the last level i.e., at the doorsteps of the citizens through a structure called Grama Sachivalayams and Ward Sachivalayams with employees being drafted from the 

[1]relevant Line Departments under the State Public Services. This structure would work as an adjunct to the existing Panchayat Raj Institutions and Urban Local bodies whose areas of operation have already been delineated under separate services constituted as A.P. Panchayat Raj Services by the Panchayat Raj & Rural Development Department of the State and Urban Local Bodies Services by the Municipal Administration & Urban Development Department of the State respectively delivering the services enumerated under the Panchayat Raj Act, AP Municipalities Act and AP Municipal Corporations Act. The activities so performed by the Panchayats and Urban Local Bodies are limited to the functions mentioned in their respective Acts;

And whereas, Government proposed establishment of “Grama Sachivalayams and Ward Sachivalayams’ structure as an adjunct to the existing Panchayat Raj & Rural Development and Municipal Administration & Urban Development Departments, enabling the Grama Sachivalayams and Ward Sachivalayams to deliver more than 540 services as on date including services such as Mutations for Corrections, Mutations for Transactions of Land Titles, Re-Issuance of Integrated/ Income/Family Member Certificate, Family Member Certificate, Income Certificate, Integrated Certificate, Record of Rights (ROR) - IB Certificate, Computerized Adangal Certificate, Payment of Water Tax for Agriculture Lands, Issue of Birth & Death Certificate, Other’ Backward Class (OBC) Certificate, Trade License - Renewal of Trade License, Title Transfer (Properly), collection of Water Charges, New Water Connections, Electricity Bill Payment, Hindu Marriage Certificate, Encumbrance Certificate,F (Field)-LINE Application (NEW), Rice Card (Member Addition, Member Deletion, Splitting, Surrender & Correction), Sand Booking, SADAREM Certificate Registration & Print SADAREM Certificate, Application for Integrated Registration of Establishment under Labour Laws etc., as per enactments of the respective Departments of the Government. Therefore, it was essential that the structure needs to be formed so as to serve as a single stop service delivery point in rural & urban areas of the State of Andhra Pradesh;

And whereas, the State as a policy measure desires to provide a new structure to deliver innumerable other citizen centric services and amenities including the indicative list of Citizen Services mentioned in the 11th Schedule and 12th Schedule of the Constitution of India;

And whereas, this new Government Institution named as ‘Grama Sachivalayams and Ward Sachivalayams Department has come into force since 2019 vide Government Orders viz. G.O.Ms No 110, Panchayath Raj & Rural Development (MDL- I) Department, dated 19-07- 2019 and G.O.Ms No.217, Municipal Administration & Urban Development (UBS) Department, dated 20-07-2019, G.O.Ms No. 156, General Administration (Cabinet-II) Department, dated 21-12-2019 & G.O.Ms No. 02, GVWV & VSWS Department, dated 16- 06- 2020. It has been a subject matter of appreciation throughout the country and various efforts for replicating the same in other States are also under process. The initial Government Orders were issued in this regard and are being subsequently amended from time to time. In order to give the legislative support for the newly created structure and the functions being performed by the Grama Sachivalayams & Ward Sachivalayams statutorily in pursuance of Government Orders issued from time to time, in pursuance of Article 162 of the Constitution of India, the present legislation is necessitated. The proposed structure does not, in any manner, interfere with the powers and functions of the respective rural or urban body;

And whereas, this Legislation is required to be given with retrospective effect i.e., from the date of coming into force of this structure i.e. 19-07-2019 vide G.O.Ms No. 110, Panchayath Raj & Rural Development (MDL-I) Department, dated 19-07- 2019 and G.O.Ms No. 217, Municipal Administration & Urban Development (UBS) Department, dated 20-07-2019, G.O.Ms No. 156, General Administration (Cabinet- II) Department, dated 21-12-2019 & G.O.Ms No. 02, GVWV & VSWS Department, dated 16-06-2020, in order to provide a statutory framework for the Sachivalayams and the composition of the same under various Government Orders, as modified from time to time;

And whereas, the legislation is also necessary to have a provision for specified independent office spaces for Grama Sachivalayams and Ward Sachivalayams, to integrate and achieve the objectives of the State policy in coordination with the Panchayat Raj Institutions & Urban Local Bodies and the officers serving thereunder as well as in other Government Institutions. It is also necessary that the duties and charts of obligations of the newly created services in this Department are independent of the autonomy exercised and services provided by the Panchayat Raj Institutions and Urban Local Bodies in their respective enactments. The objective of the State is to ensure that the structure named ‘Grama Sachivalayams and Ward Sachivalayams’ created and the existing Panchayat Raj and Urban Local Body systems work under their respective enactments while simultaneously ensure due coordination with each other;

And whereas, accordingly, Government have decided to undertake a specific new legislation for ‘Grama Sachivalayams and Ward Sachivalayams’ in the State;

And whereas, the Legislature of the State of Andhra Pradesh is not now in session and the Governor of Andhra Pradesh is satisfied that circumstances exist which render it necessary for him to take immediate action;

Now, therefore, in exercise of powers conferred by clause (1) of Article 213 of the Constitution of India, the Governor of Andhra Pradesh is pleased to promulgate the following Ordinance:-

CHAPTER-I PRELIMINARY of GSWS Ordinance - 15/2022

Short title, extend and commencement.
Definitions.
  • 1. (1) This Ordinance may be called the Andhra Pradesh Grama Sachivalayams and Ward Sachivalayams (GSWS) Ordinance,2022.
  • (2) It extends to the whole of the State of Andhra Pradesh.
  • (3) All the provisions of this Ordinance except sections 11,12,13 and 15 shall be deemed to have come into force with effect from 19-07-2019, the sections 11, 12, 13 and 15 shall come into force at once.
2. In this Ordinance, unless the context otherwise requires,-
  • (1) “Ordinance” means the Andhra Pradesh Grama Sachivalayams and Ward Sachivalayams (GSWS) Ordinance, 2022;
  • (2) “Citizen Service” means facility organized and provided by the Government Departments or by a statutory body for benefit of all the people;
  • (3) “Commissioner” means the Commissioner/ Director of the Grama Sachivalayams and Ward Sachivalayams (GSWS) Department;
  • (4) “Competent Authority” means appointed by the Government to discharge functions mentioned under this Ordinance or rules or standing orders made thereunder;
  • (5) “Department” means Grama Sachivalayams and Ward Sachivalayams (GSWS) Department and includes Commissioner/Director or .Competent Authority appointed by the Government to discharge functions mentioned under this Ordinance or rules or standing orders made there under;
  • (6) “District” means administrative division as created by the State Government;
  • (7) “Functionaries” means the employees of the line departments working in the Sachivalayams in urban and rural areas and responsible for discharging duties as set out by the appropriate Government;
  • (8) “Government” means the State Government of Andhra Pradesh;
  • (9) “Line Departments” means Departments within the Government of Andhra Pradesh and Government Corporations;
  • 10) Notification” means a notification in the official gazette of the State including a district gazette;
(11) “Rules” means a rules made under this Ordinance by the Government;

(12) “Sachivalayams” means the building / area/ structure/office established under various Government Orders issued hitherto and controlled / managed / monitored by the Commissioner, GSWS Department and called Grama Sachivalayams in Rural Areas, Ward Sachivalayams in Urban Areas;

(13) “Service Charge” means fee collected/levied by the Department from the users for providing Citizen Services;

(14) “State” means State of Andhra Pradesh;

(15) “Welfare schemes” means assistance program sponsored by the Government for individuals and families in need in the State of Andhra Pradesh.

CHAPTER –II of The AP Grama Sachivalayams and Ward Sachivalayams (GSWS) Ordinance, 2022

ESTABLISHMENT OF GSWS DEPARTMENT AND DECLARATION OF GRAMA SACHIVALAYAMS AND WARD SACHIVALAYAMS

3. (a) In accordance with the provisions of this Ordinance, there shall be constituted a department called the Department of ‘Grama Sachivalayams and Ward Sachivalayams’, hereinafter called as the Department’, for monitoring of the Grama Sachivalayams and Ward Sachivalayams already established in rural and urban areas across the State.

(b) The existing system of ‘Grama Sachivalayams and Ward Sachivalayams’ established under various Government Orders issued by the Government from time to time shall be deemed to have been organized and constituted under the provisions of the Ordinance.
  • (c) The Grama Sachivalayams and Ward Sachivalayams Department shall constitute,-
  • (i) Special Chief Secretary / Principal Secretary / Secretary to “Government, GSWS Department.
  • (ii) Commissioner/Director, GSWS Department.
  • (iii) Director, AP State Institute of Rural Development and Panchayat Raj (APSIRDPR).
  • (iv) The Functionaries of ‘Grama Sachivalayams and Ward Sachivalayams’ and the staff drafted for the Department, either on deputation or otherwise. The staffing pattern and the criteria/eligibility .thereof shall be consistent with Article 309 of the Constitution of india.

Establishment of GSWS Department.

Designation officer.
4. (a) The Government shall appoint a Special Chief Secretary / Principal Secretary / Secretary to the Department.
(b) The Secretary shall be from the All-India Services and should be at the level of Secretary cadre or higher.
(c) The Secretary shall be responsible for overseeing the functioning of the GSWS Department by the Government.
(d) The Secretary shall be assisted by the Commissioner/Director, as may be prescribed under this Ordinance.

Appointment of Commissioner/ Director.
5 (a) The Government shall appoint a Commissioner/ Director to the Department.
(b) The Commissioner/Director shall be from the All- India Services.
(c) The Commissioner/Director shall be responsible for the day-to-day functioning of the Department and work through District Administration and the Sachivalayams established.
(d) The Commissioner/Director shall be assisted by Officers and other appointed staff as per regulations laid down in this Ordinance.
(e) Commissioner/Director shall review the performance of Grama Sachivalayams and Ward Sachivalayams periodically and take appropriate steps to streamline the functioning of Sachivalayams including recommendations for initiation of disciplinary proceedings against the Functionaries wherever found appropriate.  

Appointment of Director for APSIRD.
6. The Government shall appoint a Director for APSIRD,- 
(a) Director shall be responsible for the day-to-day functioning of the APSIRDPR and work through Regional Extension Training Centers.
(b) The Director shall conduct and review periodical training of the Functionaries and Staff of the GSWS Department.

Appointments in the Department.
7. The cadre strength of various categories of posts in the Department shall be notified by the Government from time to time in accordance with Article 309 of the Constitution of India.  

Appointment of Additional Staff.
8. The Commissioner/Director with prior permission of Government is authorized to,-
(i) Engage and remunerate staff including Service Providers, and Consultants on contractual basis and/or
(ii) Appoint aforementioned staff from the Government and/or external consultants, on contractual basis and/or deputation.

Functionaries of Grama Sachivalayams and Ward Sachivalayams Department.
9.The following functionaries of the various Line Departments are to be positioned to perform the functions in the Grama Sachivalayams and Ward Sachivalayams as detailed below:-

Note 1: Mahila Police or Grama Mahila Samrakshana Kaiyadarshi/ Ward Mahila Samrakshana Kaiyadarshi (or by any other designation it is called) shall not be a ‘Police’ within the meaning of Indian Police Act, 1861 or such other laws which govern functioning of the Police Department in the State of Andhra Pradesh.
Note 2: Allotment of the functions to the functionaries shall be in accordance with guidelines issued from time to time by the Government or the Line Department as the case may be.
